On Monday, February 25, 2019, Judge Linda Marks of the Orange County Superior Court issued a favorable ruling on a motion for summary judgment brought by Julander, Brown & Bollard in a case that was scheduled to go to trial in March of this year. The ruling will remove JBB’s client, a large New York based holding company, from a case alleging disputed breach of warranty claims against JBB’s client in the amount of $11 million. The ruling comes after an extensive, multi-state discovery campaign which resulted in evidence that the plaintiff waited too long to bring its claims under the applicable statutes of limitations and failed to comply with the provisions of the California Commercial Code regarding the sale of goods.
