Mercury Cable & Energy, Inc.

Mercury Cable & Energy, Inc., is an innovator in the electrical transmission industry. It developed new products which substantially improved efficiency in the transmission of electricity through overhead electrical lines. When Mercury was sued for misappropriation of trade secrets by one of its competitors Mercury came to Dirk Julander and JBB to defend it in that litigation against two large and well known law firms. The litigation was extensive and involved many technical issues. We believed that the real underlying purpose of the litigation was an effort by Mercury’s competitor to obtain Mercury’s trade secrets. Mr. Julander and the JBB staff fought vigorously on this and many other issues and were ultimately successful. The matter was settled on very favorable terms and the competitor never received access to Mercury’s trade secret information. Mercury continues to rely on JBB for its legal needs today.

International Representation

Bill Bollard’s practice includes representing clients’ international interests. Having lived in Latin America for five years, he is fluent in Spanish and is very familiar with civil and criminal law and procedure in a variety of foreign jurisdictions. Mr. Bollard has participated in international arbitrations, including the first NAFTA claim before the World Court. Mr. Bollard has represented several high profile clients in cross-border matters that received international press attention, including the Scott McClung, David Cathcart and Duane Chapman (“Dog the Bounty Hunter”) matters. James Stephanian and WTI Communications, Inc.

A significant area of JBB’s practice is what we call “business divorce.” When James Stepanian was being driven out of the business he founded, WTI Communications, Inc., by his partners he came to Dirk Julander and JBB to help him resolve this problem as quickly and efficiently as possible. Although this type of litigation can be contentious, Mr. Julander created a working relationship with opposing counsel that resulted in a creative settlement agreement leaving the valuation of the business up to a neutral arbitrator. Mr. Julander and JBB represented Mr. Stepanian in that arbitration and were very successful in obtaining a significant seven figure valuation for the business which resulted in a large settlement making Mr. Stepanian whole for the hard work and energy he put into creating the successful business.

Qycell Corporation

Qycell Corporation is an industry leader in the manufacturing of cross-linked foam products throughout the United States and internationally. It supplies innovative and superior quality cross-linked foam products to many businesses in the automotive, construction, recreation and athletic industries. Richard Brown and JBB have represented Qycell in a variety of legal actions and matters over the years. In one case, JBB brought an action on Qycell’s behalf to recover substantial damages caused by the failure of an energy co-generation system it had purchased for its Ontario, California facility. Despite the bankruptcies of two of the principal defendants, JBB was successful in pursuing the defendants’ insurance coverage and, raising novel coverage issues, was able to obtain a significant settlement of the action based on melted foam products that resulted when the co-generation system malfunctioned. JBB continues to be a trusted advisor to Qycell offering cost effective and creative resolutions to difficult legal issues.

Atlantic-Pacific Processing Systems

As the credit card payments industry grows more multifarious, ISO’s and acquiring banks are in greater need for competent counsel who understand the industry and are capable of litigating complex disputes. When Atlantic-Pacific Processing Systems (APPS) needed counsel to handle disputes burdening its business, it came to JBB and Dirk Julander for help. For over a decade, Mr. Julander has provided counsel and handled litigation matters to relieve APPS of many significant disputes. Among the many cases Mr. Julander helped APPS with, he obtained a favorable defense jury verdict in a case brought by disgruntled merchant. After the verdict was announced, the jury took the opportunity to explain to Mr. Julander how grateful they were to learn that a company like APPS was on the job behind the scenes protecting the public from fraudulent activities by unscrupulous merchants.
